1. About these terms
These terms govern your access to and use of the Finacco website (finacco.com.au) and any related content, forms, or tools we make available through it. By accessing or using this website you agree to these terms. If you do not agree, you must not use the site.
Our professional services are engaged separately through a written engagement letter. Those engagement terms, not these website terms, govern any accounting, bookkeeping, payroll, advisory, automation, or due-diligence work we do for you. In the event of any inconsistency, the signed engagement letter prevails for matters within its scope.
2. Use of the website
You may use this website for lawful personal and business purposes only. You must not, and must not attempt to: (a) interfere with, damage, disable, overburden, or impair the site; (b) gain unauthorised access to the site, its servers, or any related systems; (c) use any automated means (including bots, crawlers, scrapers, or AI agents) to access, copy, or harvest content other than for legitimate search-engine indexing; (d) reverse engineer, decompile, or attempt to derive the source of any part of the site; (e) misrepresent your identity or any affiliation with Finacco; or (f) use the site or its content to compete with Finacco or to train, fine-tune, or evaluate any machine-learning model without our prior written consent.
We may suspend, restrict, or terminate your access to the site at any time, without notice, if we reasonably consider that you have breached these terms or that your use poses a risk to Finacco, our clients, or other users.

All content on this website — including text, images, graphics, layouts, code, logos, brand marks, and trade dress — is owned by Finacco or used under licence and is protected by Australian and international copyright and trade-mark laws. All rights are reserved.
Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to view, download, and print content for your own non-commercial reference. Any other use — including reproduction, republication, distribution, modification, public display, commercial use, or use as input to or training data for any AI or machine-learning system — requires our prior written permission.
Nothing on this website should be read as granting any licence or right to use any Finacco trade mark, logo, or brand element without our prior written consent.
4. Submissions and user content
If you submit information, content, feedback, or suggestions to us through the website (for example via the contact form), you represent that you are entitled to do so and that the content is accurate and lawful. You grant Finacco a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, store, copy, and act on that content for the purpose of responding to your enquiry, providing our services, complying with our legal obligations, and improving our offering.
You must not submit content that is unlawful, defamatory, misleading, infringing, confidential to a third party without authority, or harmful (including viruses or malicious code). We may delete or refuse to act on any submission at our discretion.

To the maximum extent permitted by law, Finacco, its directors, employees, contractors, and agents are not liable to you or any third party for any direct, indirect, incidental, consequential, special, exemplary, or punitive loss or damage of any kind — including loss of profit, revenue, business, goodwill, data, or opportunity — arising from or in connection with your access to or use of this website, any content on it, or any inability to access it, whether in contract, tort (including negligence), statute, or otherwise.
Where a non-excludable consumer guarantee, condition, or warranty applies under the Australian Consumer Law or any other law, our liability is limited (where the law permits) to: in the case of services, the resupply of the services or payment of the cost of resupply; and in the case of goods, the replacement of the goods or payment of the cost of replacement.
Nothing in these terms limits rights you may have under the Australian Consumer Law that cannot lawfully be excluded.

Finacco is not liable for any failure or delay in performing its obligations under these terms where the failure or delay is caused by events beyond its reasonable control, including acts of God, natural disasters, pandemics, government actions, cyber-attacks, internet or telecommunications failures, or third-party service outages.
12. Assignment, severability, and entire agreement
You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign or transfer our rights and obligations at any time without your consent. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect. These terms, together with our Privacy Policy, Disclaimer, and any applicable engagement letter, set out the entire agreement between you and Finacco in relation to the website.
13. Governing law and jurisdiction
These terms are governed by the laws of the State of Victoria, Australia. You and Finacco submit to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia sitting in Victoria for any dispute arising out of or in connection with these terms.
